1. About these terms
These terms are an agreement between you and Flap Tech Pvt. Ltd., Lazimpat-2, Kathmandu, Nepal (“Flap”, “we”, “us”). They cover flaap.me, the Flap Shop at shop.flap.com.np, Flap NFC cards, tags, stands and QR codes, business dashboards and related apps (the “Services”).
By creating an account, placing an order or using the Services you agree to these terms and to our Privacy Policy. If you use Flap for a business, you confirm that you may accept these terms for that business.
2. Who can use Flap
You must be at least 16 years old to create an account. If you are under 18, you need a parent or guardian’s permission to buy products or paid plans. You must give accurate information and keep it up to date.
3. Your account
- Keep your password and sign-in methods private. You are responsible for what happens in your account.
- Tell us straight away at legal@flap.com.np if you think someone else has used it.
- Your username / Flap ID is part of your public link. We may reclaim names that impersonate others, infringe trademarks or are not used.
- You can delete your account at any time in your profile settings.
4. Your public profile and sharing
Your Flap profile is designed to be shared. Anything you put on it can be seen by anyone who taps your product, scans your QR code or opens your link, and may be saved or forwarded by them. Only add what you are happy to share, and only add other people’s details (for example emergency contacts or staff) if they agree.
We are not responsible for how people you share your profile with use your information.
5. Flap products and orders
Ordering
- Prices are shown in Nepali rupees and include any taxes stated at checkout. Delivery charges are shown before you confirm.
- An order is accepted when we confirm it. We may cancel an order (and refund anything paid) if an item is unavailable, the price was clearly wrong, or we suspect fraud.
- Payment is by cash on delivery or the online methods shown at checkout.
- Delivery times are estimates. We will tell you if your order is delayed.
Returns and faulty items
- If an item arrives damaged, faulty or not what you ordered, tell us within 7 days of delivery and we will repair, replace or refund it.
- Cards, stands and other products printed or engraved with your name, logo or design are made for you, so they cannot be returned just because you changed your mind. Your legal rights for faulty items are not affected.
- Unused, non-personalised items can be returned in their original condition within 7 days; you pay the return delivery.
How the NFC products work
- Flap products open your page on flaap.me. They work with most modern phones; some phones need NFC turned on or need the QR code instead.
- The product itself has no battery and does not track its own location. Lost-item features rely on someone tapping or scanning it.
- If you lose a linked product you can unlink it or turn on lost mode from your dashboard.
6. Paid plans and Flap Points
- Some features need a paid plan (for example Pro or dynamic QR codes). The price, length and what is included are shown before you pay.
- Plans do not renew automatically unless this is clearly shown and you agree to it. When a plan ends, paid features stop and your basic profile keeps working.
- Flap Points and in-app credits have no cash value, cannot be transferred or sold, and may expire or change as shown in the app. We may correct points earned by mistake or through misuse.
7. Using Flap for a business
If you run a business page, menu, shop, loyalty programme or bookings on Flap:
- You are the seller. The contract for your products and services is between you and your customer. You are responsible for your prices, stock, menus, allergens and descriptions, delivery, refunds, taxes and any licences you need.
- Customer data. You may only use customer details you receive through Flap (orders, loyalty members, bookings, enquiries) to serve those customers, and you must follow the privacy laws that apply to you. Do not send marketing to customers who have not agreed to it.
- Staff. You decide who can manage your page and you are responsible for what they do.
- Loyalty and offers. You must honour the rewards and offers you publish.
8. Reviews and ratings
Reviews help other customers, so they must be honest. When you write a review you agree that:
- It is based on your own real experience with that business or product.
- You are not the owner, a staff member or a competitor, and you have not been paid or rewarded for it.
- It does not contain abuse, hate, private information about others, or false statements of fact.
Reviews marked Verified come from people who have a recorded visit, loyalty membership or order with that business. Businesses can reply publicly but cannot edit, hide or delete reviews, and must not offer rewards for reviews or ask only happy customers to review. We may remove reviews that break these rules or the law, and you can report a review to legal@flap.com.np.
9. Lost items, vehicle alerts and emergency contacts
- These features help people contact you. We cannot guarantee that a lost item will be found, that a message will be delivered, or that an alert will arrive in time. Do not rely on Flap in an emergency — call the police, ambulance or fire service.
- If you send an alert or report a found item, your name, phone number, message and location are shared with the owner as explained in our Privacy Policy.
- Sending false, abusive or repeated alerts is not allowed. We may block the device or network address that sends them.
- Blood type and medical details on your profile are for information only and are not a medical record.
10. Things you must not do
- Break the law, or help anyone else to.
- Impersonate a person or business, or create a profile for someone without their permission.
- Post content that is illegal, hateful, harassing, sexually explicit, misleading or that infringes someone else’s rights.
- Send spam or unwanted messages, scrape the Services, or collect other users’ data without permission.
- Use Flap products or links for phishing, scams or to hide where a link really goes.
- Try to break, overload or get around the security of the Services, or use them to spread malware.
11. Your content
You keep ownership of the text, photos, logos and other content you add. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, display and share it only as needed to run and show the Services (for example, showing your profile when someone taps your card). The licence ends when you delete the content or your account, except for copies others have already saved.
You confirm you have the rights to the content you upload. We may remove content that breaks these terms or the law.
12. AI assistant
The Flap AI assistant can make mistakes. Check important information, such as figures, prices or messages before you send them. You are responsible for messages you send to customers, even if the assistant drafted them.
13. Other services
Your profile can link to other websites and apps (for example WhatsApp, Google Maps, social networks and payment apps). Those services have their own terms and we are not responsible for them.
14. Our rights
The Flap name, logo, designs, software and website content belong to Flap Tech Pvt. Ltd. or our licensors. You may not copy, modify or resell them, or use the Flap name in a way that suggests we endorse you, without our written permission.
15. Availability and changes to the Services
We work to keep the Services running, but they may sometimes be unavailable for maintenance or reasons outside our control. We may change or stop features. If we stop a paid feature you have already paid for, we will give you a fair refund for the unused part. If we ever close the Services entirely, we will give at least 60 days’ notice so you can export your data.
16. Suspension and closing accounts
You can stop using Flap and delete your account at any time. We may suspend or close an account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or to protect other users. Unless it would be unlawful or create a risk, we will tell you why and give you a chance to respond. You can appeal by emailing legal@flap.com.np.
17. Our responsibility to you
We provide the Services with reasonable care and skill. Apart from that, and to the extent the law allows, the Services are provided “as is”.
We are not responsible for losses that were not foreseeable, for business losses such as lost profit, or for the actions of other users, businesses or people you share your profile with. Our total responsibility for any claim is limited to the amount you paid us in the 12 months before the claim, or NPR 5,000 if that is higher.
Nothing in these terms limits responsibility for death or personal injury caused by negligence, for fraud, or any other responsibility that cannot be limited by law. If you are a consumer, you keep all the rights that consumer protection law in your country gives you.
If you use Flap for a business, you agree to cover our reasonable costs if a claim is made against us because of your products, services, content or how you handle customer data.
18. Changes to these terms
We may update these terms when the Services or the law change. We will tell you about important changes by email or in the app at least 15 days before they apply. If you do not agree, you can delete your account before then.
19. Law and disputes
These terms are governed by the laws of Nepal, and disputes go to the courts of Kathmandu. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country and may bring a claim in its courts. Please contact us first — most problems can be solved quickly.
